Terms of Use

Chapter 1 General Provisions

Article 1 (Purpose)

The purpose of this Agreement is to prescribe the rights, obligations and responsibilities of the Company and its users in using Internet services (hereinafter referred to as services) provided by the Korea Center for Regulatory Science (hereinafter referred to as the Center).

Article 2 (Effects and Changes of Terms and Conditions)

  • ① These terms and conditions take effect by disclosing them using the web page of the Korea Center for Regulatory Science or by e-mail.
  • ② In the event of a reasonable reason, the company may revise the contents of the terms and conditions without the prior consent of the members, and the changed terms and conditions will take effect by disclosing them online.
    However, the revision of important regulations such as the rights or obligations of users will be notified in advance.
  • ③ Agreeing to these terms and conditions means that you agree to visit the website regularly to check for changes in the terms and conditions. The company is not responsible for any damage to users caused by not knowing the information about the changed terms and conditions.
  • ④ Members may request withdrawal (cancellation) if they do not agree to the changed terms and conditions, and if they do not request termination within 14 days after the effective date of the changed terms and conditions, they are considered to have agreed to the changes.

Article 3 (External Rules)

Matters not specified in these Terms and Conditions shall be subject to the provisions of the Framework Act on Telecommunications, the Telecommunications Business Act, the Promotion of Information and Communication Network Utilization, and other relevant statutes.

Article 4 (Definition of Terms)

The key terms used in these Terms and Conditions are defined as follows.

  • 1. Center: Korea Center for Regulatory Science, a foundation that provides Internet services related to regulatory science
  • 2. Member: A person who has signed a service use contract with the center and has been granted a user ID.
  • 3. ID: It refers to a character, number, or combination of characters selected by members and approved by the Center for the identification of members and the use of services by members (hereinafter referred to as ID).
  • 4. Password: It is a combination of letters and numbers determined by the member to confirm that the member is a member who matches the ID given and to protect the member's own secret.
  • 5. Suspension of use: Refers to restrict the use of services by the Center based on the terms and conditions.
  • 6. Termination: The termination of a contract of use by a company or member after the use of a service.

Chapter 2 Service Use Contracts

Article 5 (Construction of a contract for use)

  • ① When you apply for a subscription to the service, you will be considered to agree to these terms and conditions by reading and clicking the Accept button.
  • ② The use contract is established when the center approves the application for use after consenting to the terms and conditions of use of the service.

Article 6 (Application for Use)

Those who wish to join as members and use the service shall apply for use by providing personal information requested according to the prescribed form set by the Center.

Article 7 (approval of application for use)

  • ① The Center shall accept the application for use under Article 6 in the order of receipt, unless there are special circumstances.
  • ② The Center may refuse to accept the application for a use contract when it recognizes any of the following matters.
    1. If you don't apply under your real name
    2. If you apply using someone else's name
    3. Where an application is made by falsely stating necessary matters when applying for use
    4. Where an application is made for the purpose of hindering the well-being and order or beauty of society
    5. Where other application requirements for use set by the Center are insufficient
  • ③ Where the consent of the application for use is reserved or not accepted pursuant to paragraph (2), the Center shall notify the applicant: Provided, That the foregoing shall not apply where it is impossible to notify the applicant without reasons attributable to the company.

Article 8 (Protection of Personal Information)

  • ① The center protects and respects members' personal information.
  • ② When applying for use, the Center collects information on members through information provided by members, community activities, information provided by members to participate in various events, and information collected in the process of using other services, and the personal information of members is used for the purpose of implementing this use contract and providing services under this use contract.
  • ③ The Center shall not divulge or distribute personal information of members acquired in connection with the provision of services to a third party without his/her consent and shall not use it for commercial purposes: Provided, That this shall not apply in any of the following cases.
    1. Where it is necessary for the settlement of charges for the provision of information and communication services
    2. Where it is necessary for statistics preparation, academic research, or market research, and is processed and provided in a form that a specific individual cannot be identified
    3. Where there is a request from the relevant agency in accordance with the procedures and methods determined for investigative purposes under the relevant statutes
    4. If there are special provisions in other laws
    5. Where the Information and Communication Ethics Committee requests in accordance with relevant Acts and subordinate statutes
  • ④ Within the scope of paragraph 3, the Center may prepare and use collective statistical data on the personal information of all or part of the members in relation to their duties, and may send cookies to the members' computers through services. In this case, members may refuse to receive cookies or change the browser settings on the computers that they use to warn against them.
  • ⑤ The user's personal information is in accordance with the relevant laws and regulations and the personal information protection policy set by the Blue Web.

Article 9 (Use of Personal Information)

  • ① The personal information collected by the Center shall be to the minimum required for the provision of services, but may require more detailed information than is required.
  • ② Where the Center entrusts the provision of specific services to an external enterprise (hereinafter referred to as an entrusted enterprise), it may provide the personal information of the members necessary for the provision of services to the entrusted enterprise with the consent of the members, and specify the fact of entrustment of services. The entrusted enterprise shall not use it for any purpose other than the entrusted purpose or provide it to a third party in the collection, handling, and management of the personal information of the members provided.
  • ③ Members may withdraw their consent to the collection and use of personal information provided to the Center at any time if desired, and withdrawal of consent consists of filing an application for termination.

Chapter III Duties of Contracting Parties

Article 11 (Duties of the Center)

  • ① The center allows members to use the service on the day they apply for the use of the service unless there are special circumstances.
  • ② The Center shall continuously endeavor to provide continuous and stable services as prescribed in these terms and conditions, and shall repair and recover the facilities without delay when they are damaged or destroyed: Provided, That in cases of natural disasters, emergencies, or other unavoidable circumstances, the service may be temporarily suspended or suspended.
  • ③ The Center shall abide by the provisions of Article 8 in relation to the protection of the privacy of its members.
  • ④ The Center shall endeavor to provide convenience to the users in the procedures and contents related to the contract with the users, such as the conclusion of the contract, change and termination of the contract.

Article 12 (Duties of Members)

  • ① A member shall comply with the matters announced by the Center through the matters prescribed in these terms and conditions, guidance on use, public announcement, etc., and shall not engage in any other acts that interfere with the work of the Center.
  • ② Members are responsible for all management of their IDs and passwords. Members are responsible for any consequences caused by negligent management of IDs and passwords granted to members and fraudulent use.
  • ③ If a member discovers that his/her ID or password has been used illegally, he/she shall immediately report it to the center, and the member shall be responsible for any consequences arising from not reporting.
  • ④ A member shall not transfer or gift the right to use the service or other use contractual status to another person without the express consent of the Center, and shall not provide it as collateral.
  • ⑤ A member shall not engage in business activities using the service without prior consent from the Center, and the Center shall not be liable for the results of such business activities and the results of the member's business activities in violation of the terms and conditions. A member shall be liable for damages to the company if the company suffers damage due to such business activities.
  • ⑥ A member shall not engage in any of the following acts in connection with the use of the service.
    1. The act of stealing the ID, password, resident registration number, etc. of another member
    2. Reproducing information obtained through this service for purposes other than the use of members without prior consent from the company, using it for publication, broadcasting, etc., or providing it to a third party
    3. Posting or disseminating to others by e-mail or other means the contents that infringe on other people's patents, trademarks, trade secrets, copyrights, and other intellectual property rights
    4. The act of transmitting, posting, e-mailing, or other means of distributing low-speed, obscene information, sentences, figures, etc. to others in violation of public order and customs
    5. Any act of sending, posting, e-mailing, or otherwise disseminating to others content that is offensive or threatening and may infringe on the privacy of others
    6. an act that is objectively judged to be linked to a crime
    7. Collecting or storing other users' personal information without obtaining approval from the Center
    8. Other acts in violation of relevant laws and regulations

Chapter 4 Service Use Contracts

Article 13 (Scope of Service Use)

Members can use all of the Korea Regulatory Science Center sites with the ID issued upon signing up through the center.

Article 14 (Providing Information)

The Center may provide members with various information deemed necessary while using the service by means of notice or e-mail.

Article 15 (Charges and Paid Information and Payment, etc.)

The service provided by http://www.k-rsc.or.kr is basically free.

Article 16 (Post of Members)

  • ① The Center may delete the contents of the service posted or registered by the member without prior notice where it is deemed to fall under any of the following subparagraphs.
    1. Where it is a content that smears another member or a third party or damages the reputation by slander
    2. Where the content is in violation of public order and good manners
    3. Where the content is deemed to be linked to a criminal act
    4. Where the content infringes on the copyright of the Center, copyright of a third party, etc
    5. When the period or capacity of posting prescribed by the Center is exceeded
    6. Where a member posts obscene materials or links obscene sites on his/her website and bulletin board
    7. In the case of posts that do not conform to the nature of the bulletin board
    8. Where it is deemed to be in violation of other relevant laws and regulations

Article 17 (copyrights of posts)

  • ① The rights to materials published in the service are as follows.
    1. The right and responsibility for the post rests with the publisher, and the Center shall not use it for commercial purposes other than publication in the service without the consent of the publisher: Provided, That this shall not apply to non-profit cases, and the Center shall have the right to publish within the service.
    2. Members may not commercially use materials published in the service, such as processing and selling information obtained using the service.

Article 18 (Transactions with Advertising Publishers and Advertisers)

  • ① Part of the service investment base on which the center can serve its members comes from revenue from advertising. Those who wish to use the service are considered to agree to the advertising that are exposed when using the service.
  • ② The Center shall not be liable for any loss or damage that is posted on this Service or as a result of communications or transactions by members of the Advertiser's promotional activities through this Service.

Article 19 (Time to use the service)

  • ① In principle, the service shall be available 24 hours a day, 24 hours a day, 24 hours a day, 24 hours a year, unless there is any special obstacle to the business or technical affairs of the association: Provided, That the date or time set by the Center shall not apply to the need for regular inspections, etc.
  • ② The Center may divide the services into a certain range and separately determine the available hours for each range. In such cases, the details thereof shall be notified by prior notice.

Article 20 (Liability for Service Use)

A member shall not engage in business activities to sell products using services, except as specifically permitted in an explicit document signed by an authorized employee at the Center, and shall not engage in hacking, profit-making advertisements, commercial activities through obscene sites, illegal distribution of commercial S/W, etc. The Center shall not be responsible for the results and losses of business activities caused by violating this, and legal measures such as arrest by related agencies.

제 21 조 (서비스 제공의 중지 등)

  • ① The Center may stop providing services in any of the following cases.
    1. In case of inevitability due to construction, such as repair of service facilities, etc
    2. When a telecommunications service provider suspends telecommunications services as prescribed by the Telecommunications Business Act
    3. If there are other force majeure reasons
  • ② The Center may restrict or suspend all or part of services when the use of services is hindered by a national emergency, power outage, failure of service facilities, or congestion of service use.
  • ② When the Center restricts or suspends the use of services pursuant to paragraphs (1) and (2), it shall notify the members of the reasons, the period of restriction, etc. without delay.

Chapter 5 Termination of Contracts and Restrictions on Use

Article 22 (Cancellation of Contracts and Restrictions on Use)

  • ① If a member wants to terminate the use contract, the member himself/herself must apply to the center for withdrawal from the membership through e-mail.
  • ② When a member commits any of the following acts, the Center may terminate the contract of use without prior notice or suspend the use of the service by setting a period.
    1. In case of theft of another person's personal information, ID, and password
    2. The name you joined is not your real name
    3. Where a person commits an act that damages or disadvantages the reputation of another person
    4. infringement of the intellectual property rights of the company, other members, or third parties
    5. In the case of deliberately disseminating content that is hindered by public order and beauty
    6. Where a member plans or implements the use of services for the purpose of undermining the national interest or social interest
    7. Intentionally obstructing the operation of the service
    8. In the case of transmitting a large amount of information or transmitting advertising information for the purpose of hindering the stable operation of the service
    9. In the case of disseminating computer virus programs, etc. that cause malfunction of information and communication facilities or destruction of information
    10. In the case of a request for correction by an external agency, such as the Information and Communication Ethics Committee, or an interpretation of the authority of the Election Commission in connection with an illegal election campaign
    11. Where the information obtained using the services of the Center is reproduced or distributed without prior consent of the Center or used commercially
    12. Where a member posts obscene materials on his/her website and bulletin board or links to obscene sites
    13. If there is no service usage record (login record) within the last 3 months
    14. In the case of transmitting the mail prescribed in Article 18(3)
    15. In violation of the terms and conditions of use set by the Center, including these terms and conditions

Chapter 6 Service Use Contracts

Article 23 (Compensation for damages)

The Center shall not be liable for any damages incurred to the Member in connection with the use of the free service.

Article 24 (Exemption Clause)

  • ① If the Center is unable to provide services due to natural disasters or equivalent force majeure, the Center shall be exempted from the responsibility for providing services.
  • ② The Center shall not be responsible for any disability in the use of services due to reasons attributable to members.
  • ③ The Center shall not be responsible for the loss of revenue expected by the Member using the Service or for any damage caused by the data obtained through the Service.
  • ④ The Center shall not be responsible for the information, data, reliability, accuracy, etc. posted by members on the service.
  • ⑤ The Center shall not be liable for damages caused by intention or negligence of the subscriber among damages incurred to the subscriber in connection with the use of the service.

Article 25 (Jurisdiction Court)

If a lawsuit is filed against a dispute arising from the use of the service, the court having jurisdiction over the location of the center's headquarters shall be the exclusive jurisdiction court.
